Terms of Service

Introduction

These Terms of Service (the “Terms”) are a contract between you and Small Pics LLC (“Small Pics,” “we,” or “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Small Pics is a service intended exclusively for use by businesses and professionals. We do not offer services for personal or household use.

Accounts and eligibility

• You must have legal capacity and act on behalf of a business or organization.
• Keep credentials and API keys confidential and rotate them if compromised.
• Provide accurate account and billing information and keep it current.
• You are responsible for activity under your account.

What the Service does

Small Pics optimizes, transforms, caches, and delivers images on demand through an API and delivery layer. Unless you add a hosting feature, your origin storage remains your responsibility. Cached items may persist for a period even after removal from your origin.

Requests, cache, and rendering

• Requests may be served from cache or rendered on the fly.
• We honor cache headers where practical, but cache duration is not guaranteed.
• Misses and renders count toward plan limits and may incur overage charges.

Plans, pricing, and billing

• Plan pricing is listed in U.S. dollars on our pricing page or in the dashboard.
• Subscriptions renew automatically until canceled in billing settings.
• We bill in advance for the upcoming term and for any metered usage or overages.
• Unpaid or failed charges may result in suspension or throttling.
• You are responsible for taxes unless we state otherwise.

Your content

You own the images and related material you provide (“User Content”). You grant Small Pics a non-exclusive, worldwide, royalty-free license to store, cache, transform, reproduce, and deliver User Content as needed to operate, secure, and improve the Service and for internal operations such as debugging, abuse prevention, and capacity planning.

Acceptable use

• No unlawful, infringing, deceptive, or harmful content or activity.
• No malware, exploits, or attempts to degrade platform stability.
• No reselling or providing the Service to third parties without written consent.

We may block requests, remove cached material, or suspend access when we reasonably believe the rules are being violated.

Small Pics IP

The platform, software, documentation, and all non-User-Content materials are owned by Small Pics and its licensors. We grant you a limited, revocable, non-transferable right to use the Service in accordance with these Terms. No other rights are granted.

Feedback

Feedback is voluntary. You grant us permission to use suggestions and ideas without restriction or obligation.

Security, telemetry, and analytics

We collect request logs, performance metrics, and processing metadata to operate, secure, and improve the Service. We may publish aggregated, de-identified insights.

Third-party services

The Service may integrate with or link to products we do not control. Your dealings with third parties are solely between you and them.

Trademarks

Small Pics names, logos, and product marks belong to Small Pics LLC. Other marks are the property of their owners. You may not use our marks without written permission.

Copyright notices

We honor valid notices under the DMCA. Send alleged infringement claims to getsmallpics@gmail.com with the information required by 17 U.S.C. § 512(c)(3).

Changes to the Service

We evolve the platform over time and may add, change, or retire features. For material changes, we will provide notice by email or in the product.

Suspension and termination

We may suspend or end access to protect the platform or for violations of these Terms. You can cancel anytime in billing settings. Credits and refunds are governed by our Refund & Billing Policy. Cached copies may persist briefly after termination.

Privacy

Our Privacy Policy explains how we collect and use information, including GDPR-relevant practices for professional users in the EU. We do not appoint an EU representative and do not market to consumers. If you process EU personal data through the Service, you are responsible for having a lawful basis and for your own controller obligations.

Disclaimers

The Service is provided as is and as available. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Local law may grant rights that cannot be disclaimed.

Limitation of liability

To the maximum extent permitted by law, Small Pics is not liable for indirect, special, incidental, consequential, or exemplary damages, or for lost profits, revenue, or data. Our total liability for all claims is limited to the greater of 100 USD or the fees you paid to Small Pics for the Service in the six months before the claim.

Indemnification

You will defend and indemnify Small Pics against claims arising from your User Content, your use of the Service, or your violation of these Terms.

Governing law and venue

These Terms are governed by the laws of the State of Ohio and the United States, without regard to conflict of laws. Exclusive venue lies in the state and federal courts in Franklin County, Ohio.

Updates to these Terms

We may revise these Terms. The date at the top will change, and when required we will provide additional notice. Continued use of the Service after changes means you accept the new version.

Miscellaneous

These Terms are the entire agreement about the Service. If a provision is unenforceable, the remainder stays in effect. You may not assign this agreement without our consent. We may assign it as part of a merger, acquisition, or asset transfer. Neither party is liable for delays caused by events outside reasonable control.
